There is currently a Vermont Case challenging the eligibility of Cruz and Marco Antonio Rubio to be on the Presidential Ballot:
D FL Rep Alan Grayson said, "Technically, (Ted Cruz is) not even an American."
Let's see what our Constitution says:
No Person shall be a Senator who shall not have attained to the Age of thirty Years, and been nine Years a Citizen of the United States, and who shall not, when elected, be an Inhabitant of that State for which he shall be chosen
No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States
Before he enter on the Execution of his Office, he shall take the following Oath or Affirmation:—"I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States."
No Title of Nobility shall be granted by the United States: And no Person holding any Office of Profit or Trust under them, shall, without the Consent of the Congress, accept of any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince, or foreign State.
If there is anyone familiar with our Constitution and laws, it might be Ted Cruz, who memorized it in high school and served as associate deputy attorney general at the United States Department of Justice, Texas Solicitor General, first Hispanic, and the longest-serving solicitor general in Texas history.
Cruz was also an adjunct professor of law from 2004 to 2009 at the University of Texas School of Law in Austin, where he taught U.S. Supreme Court litigation, having tried nine Supreme Court Cases:
Of course we also read that President Obama was a Constitutional Law professor at University of Chicago.
So let's go down the Constitutional Check List.
Ted Cruz was born on 22 December 1970 in Calgary, Alberta, Canada to a Cuban-born father who became a naturalized citizen in 2005.
His American mother was born in Wilmington, Delaware.
Cruz reportedly attended elementary and high school in and around Houston, graduated from Princeton University in 1992, and then from Harvard Law School in 1995.
As a US Senator elected in November 2012 when he was 41 years old, Cruz met the 30-year age and Texas Inhabitant when elected requirements.
We will leave the 9-year US Citizenship issue for further discussion, though it seems his political opponents might have raised it in 2012.
Cruz will be 45 years old in November 2016, old enough to be President.
Based on public information, Cruz has been a US resident for more than 14 years.
Therefore the only constitutional impediment is whether he is a natural born Citizen.
This has been an issue for several potential and actual Presidential candidates.
Barry Goldwater was born in Arizona before it was a state.
George Romney was born in Mexico.
Henry Kissinger, SoS, fourth in line for Presidential succession, was born in Germany.
Arnold Schwarzenegger was born in Austria.
John Sidney McCain was born in Panama, though potential Democratic opponents — Obama and then-Sen. Hillary Clinton — co-sponsored a Senate measure to settle McCain’s eligibility. The April 2008 resolution said, "John Sidney McCain, III, is a 'natural born Citizen' under Article II, Section 1, of the Constitution of the United States." It passed unanimously.
Several people still filed legal challenges to McCain's eligibility that were refused hearing by courts, partly because of lack of legal standing.
Barack Hussein Obama was either born in Hawaii or Kenya to an American mother and British colony born father who became a Kenyan citizen:
He released birth records described as forgeries by members of law enforcement and allegedly by Obama attorneys"
Arizona Sheriff Joe Arpaio said,
After 55 years in law enforcement, 'I think I know a fraudulent document'.
Presidential Candidate Donald John Trump also raised the issue of Obama's eligibility. As a presidential candidate, he would have standing to challenge Cruz.
Dozens of lawsuits from both parties were filed challenging Obama's eligibility. Obama allegedly spent $1.7 million in legal fees fighting them and keeping his birth and education records sealed.
Most cases were dismissed and none was heard by the US Supreme Court:
Russian Israeli emigre US Citizen Orly Taitz, who claimed Cruz, Jindal and Rubio are ineligible as not natural born citizens, came close to SCOTUS and Justice Alito, trying to stay a $20,000 fine levied by an irritated Judge in one of her many Birther cases:
One eligibility case noted two certificates of candidacy were filed by DNC Chair Nancy Pelosi, one certifying Obama's US citizenship and one not, with the second distributed to all 50 states:
The real issue is whether one American parent can provide US natural born citizenship to a child born outside America.
The first Congress of the United States passed the Naturalization Act of 1790, just three years after the Constitution was written, which stated that children born abroad to U.S. citizens were, too, natural born citizens.
Cruz is presumably a natural born citizen by being born to an American mother having her citizenship at his birth:
Another candidate or a state (eg Vermont) not certifying Cruz for candidacy may still tie up Cruz's campaign in the Courts or Congress:
The interesting issue is that no candidate other than a Democrat with a US citizenship issue has been elected in recent elections.
In November 2015, two ballot challenges were filed in New Hampshire, alleging Cruz was ineligible because he was born in Canada. The ballot commission rejected the challenges:
